CAR RENTAL AGREEMENT
With this agreement, NEKTARIOS PANTASIS, hereinafter referred to as Pantazis Rentals, rents to the signatory Renter the car listed here (including any vehicle that replaces it) under the following terms and conditions as well as those listed on its front side the Renter fully accepts.
1. DELIVERY AND RECEIPT
The renter has checked and confirmed that the condition of the car is visually and technologically good. Further complaints should be reported in writing and immediately as part of the contract. The renter agrees to deliver the car in the same condition as the tires, tools and equipment it had on the day of the agreement. If the renter does not return the car at the agreed delivery time, then each hour of delay will be charged with 1/5 of the daily charge and will be liable for any positive and detrimental damage to the business.
2. CLOSURE, DAMAGES, CONTRACTS
The Renter has the obligation to compensate Pantazis Rentals as well as every third party in the event of theft, loss or damage of the Car or third parties (including its passengers) and to pay any positive or consequential damages to Pantazis Rentals. Particularly:
(a) The Renter is liable for all damages that he has caused to the Car or to third parties if he has violated the terms of use of the Car or led it to an illegal or contrary to the provisions of the Road Traffic Code, regardless of whether he has accepted any supplementary car insurance / insurance.
(b) The Renter is liable for the partial or total theft or loss of the Car as well as for any loss or loss of the Car resulting in a collision or fire, unless Pantazis Rentals has relieved the Renter of liability for partial, total theft or loss of Car. This exemption applies insofar as the Renter has already accepted at the start of the rental the daily charge and conditions for the "TP" or “PTP” of the Vehicle and the "Disclaimer" (CDW or FDW). It is expressly agreed that the discharge covers at the bottom of the Car, the tires and the wheels of the car.
3. CHARGES
The Renter will pay to Pantazis Rentals at the start of the rental the rent for the duration of the rental, charges for additional services, cover or disposals as well as the guarantee for loss coverage. Upon the expiration of the rental, the amounts corresponding to mileage rent, the charge for filling the Car with fuel if it is returned with less fuel and the cost of repairing any damage or the exemptions agreed. The renter pays any costs of Pantazis Rentals, including lawyers' fees and default interest, due to late payment of any sums of this rental or retention of ownership and use of the CAR by Pantazis Rentals, any fines, fines, court fees and other charges imposed or any imposed on Pantazis Rentals due to violations in the use of the car by the Renter.
4. TERMS OF USE
The car is forbidden to be used: (a) To transport persons or things for a fee (b) To tow or towing cars or other objects. (c) To participate in or follow racing. (d) For subrenting to third parties. (e) For purposes contrary to Greek Laws. (f) If the Renter or the additional driver of the Car is under the influence of alcohol, hallucinogens, narcotics, barbiturates or any other substance that affects the driver's ability to drive and the senses of the driver. (g) In breach of any customs, rolling or other regulations. (h) Any third party other than the Renter and any additional driver for whom the Renter has accepted the daily charge for additional drivers as determined by the official Pantazis Rentals pricelist. (i) To carry or move heavy luggage, flammable materials, polluted or smelly objects, drugs, etc. (j) For the purpose of carrying out illegal transfers of persons or aliens or the commission of illegal acts.
If used in the aforementioned, Pantazis Rentals has the right to terminate the rental contract and to immediately discontinue the rental unilaterally, and in the event of damage, the renter has a total responsibility for the replacement of damages-damages.
5. EXTENSION OF RENTAL
If the renter wishes to extend the rental of the Car, he is required to notify Pantazis Rentals in writing at least 24 hours before the end of the rental to obtain the written approval in writing. If he fails to do so, he has civil and criminal liability for the unauthorized use and possession of the Car. In the event of an extension of the rental the Renter is bound by the terms and arrangements of both the Initial Agreement and the rental renewal agreement, whether it is the same car or another one that has been replaced.
6. RESPONSIBILITY
The Renter expressly agrees that Pantazis Rentalsis not liable for any damage or loss suffered by the renter or third parties during the rental and no claim may be raised against Pantazis Rentals for the above cause.
7. ACCIDENTS
In the event of an accident or other incident (fire, theft, etc.), the Renter or the additional driver is immediately required to: (a) not recognize fault or guilt and third party claims in any way, direct or indirect. (b) Communicate immediately by telephone or by any other means with Pantazis Rentals (c) Invite security care. (d) Notify the Police to identify the third party's fault and to care for any injured.
8. PERSONAL INFORMATION
The Renter agrees to the detailed registration of its personal data on a computer. It is agreed that Pantazis Rentals has the right to use such data only when the Renter makes false statements during the rental, violates the terms of this agreement and transmits it to the authorities of the country if there is a suspicion of a criminal or other offense.
9. JURISDICTION
This agreement is governed by Greek law and any dispute arising between Pantazis Rentals and the Renter from this agreement will be subject to the exclusive jurisdiction of the courts of Athens.
